Terms and Conditions
1) Eligibility & Age Gate
Open only to legal U.S. residents who are 21 years of age or older at enrollment. Age verification (e.g., government-issued ID) may be required.
Void where prohibited or restricted by law. Some jurisdictions limit or prohibit awarding points for alcoholic beverage purchases or redemption of alcohol-related rewards; in those places, features will be adjusted or unavailable.
2) Program Overview
Membership is free and subject to these Terms & Conditions (“Terms”).
Create an account at [program URL] (“Account”). One Account per person; non-transferable; for personal, lawful use only.
Mugen may modify, suspend, or terminate the Program at any time per Section 12.
3) Earning Points
Members may earn Points through eligible activities (e.g., brand experiences, event check-ins, purchases of branded merchandise, content interactions).
Alcohol purchase accrual: Points may not be awarded for alcohol purchases in jurisdictions that restrict such incentives. Where permitted, accrual excludes tax, tips, shipping, fees, gift cards, and discounted portions of a transaction.
Bonus offers and multipliers (when available) will be described in the offer and may be limited by date, location, or member segment.
Proof of activity (e.g., receipt upload) may be required; keep copies. Fraudulent or suspicious submissions may be rejected and may result in Account closure (see Section 10).
4) Point Value, Expiration & Inactivity
Points have no cash value, are not property, and are not transferable.
Unless otherwise stated, Points expire after 24 months of inactivity (no earn or redeem).
We may correct Point balances for errors, returns, or abuse.
5) Redeeming Rewards
Rewards (“Rewards”) and required Point levels are listed at [catalog URL] and are while supplies last.
Alcohol-related Rewards: In some states, alcoholic beverages or items redeemable for alcoholic beverages cannot be awarded; where prohibited, we’ll offer a substitute of equal or greater value (e.g., merchandise).
Rewards are not for resale; shipping limits, age-verification, and delivery restrictions may apply. We do not ship alcohol to locations where prohibited.
We may set annual caps or require additional ID checks for high-value Rewards.
6) Returns & Adjustments
If you return or cancel a qualifying activity/purchase, we may deduct Points earned from that activity.
If a Reward is unavailable, we may cancel the redemption and re-credit Points or substitute a comparable item.
7) Member Communications & Privacy
By joining, you consent to receive Program emails (operational notices, balance updates). Marketing emails/SMS require separate opt-in and remain optional; you may opt out at any time without losing Points.
Personal data is processed per our Privacy Policy at [privacy URL]. If we use endorsements/influencers in Program content or UGC, we follow applicable advertising guidance (clear, prominent disclosures of any material connection).
8) Promotions, Contests & Sweepstakes via the Program
Sometimes we offer entries or badges through the Program. If any sweepstakes or contest is offered, it will have Official Rules that govern and will not require a purchase (“NO PURCHASE NECESSARY”); membership or activities within the loyalty program cannot condition odds of winning on alcohol purchases.
State restrictions: In certain jurisdictions (e.g., California), alcoholic beverages or items redeemable for alcoholic beverages may not be a prize; substitutes will be provided as required.
Social content used for entries must include required disclosures if any incentives are provided (e.g., “#ad” where applicable).
9) Responsible Enjoyment
We promote responsible enjoyment. Do not misuse the Program to encourage excessive or underage consumption. We may remove content, decline activities, or terminate Accounts that conflict with responsible marketing standards or legal requirements.
10) Fraud, Misuse & Safe Use
We may suspend or close Accounts and void Points for suspected fraud, abuse, or violations (e.g., creating multiple accounts, falsifying receipts, automated submissions, resale of Rewards, or harassing conduct).
We may require identity or age re-verification at any time. Decisions on eligibility, Points, and Rewards are in our reasonable discretion.
11) Intellectual Property & UGC
If you submit photos, reviews, or other content (“UGC”) to participate in the Program, you grant Mugen a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that UGC for Program and marketing purposes, subject to your rights under applicable law and our Privacy Policy.
You represent that your UGC is your original work (or you have rights to share it), contains no third-party IP without permission, and complies with community standards (no illegal, hateful, or unsafe content).
12) Program Changes & Termination
We may change any aspect of the Program (including earn/redemption rates, Point expiration, catalog, or eligibility) or terminate the Program with [30] days’ notice (or shorter where required by law or for security).
If the Program ends, unexpired, unused Points will expire on the termination date unless otherwise required by law.
13) Disclaimers & Limitation of Liability
THE PROGRAM AND ALL REWARDS ARE PROVIDED “AS IS.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, Mugen DISCLAIMS ALL WARRANTIES AND IS NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF THE PROGRAM.
Some states do not allow certain limitations; in those states, these limits apply only to the extent permitted.
14) Dispute Resolution; Class Action Waiver (U.S. Only)
Informal Resolution. Contact us at [support email] within 30 days of the issue.
Arbitration. If unresolved, disputes will be individually resolved by binding arbitration administered by [AAA/JAMS] under its rules; seat [City, State]; governing law of [State] (without regard to its conflicts of law rules).
Class/Representative Actions Waiver. You and Mugen waive class actions and jury trials. Court claims limited to those that qualify for small claims.
This Section does not limit your rights where prohibited by applicable law.
15) Governing Law & Venue
